Appeal in a civil case: deadline and procedure

If the court of first instance has lost your case, the decision is not yet final — an appeal allows you to have the dispute reviewed again, from a factual and legal point of view, by a higher instance. The most important thing here is the deadline: the right to appeal is tied to a strict deadline, and its release means that the decision enters into legal force.

What is an appeal?

An appeal is a means of appealing a decision of a first instance (district/city) court. The case is heard by the appellate court, which is authorized to review both the correctness of the application of the legal norm and the factual circumstances of the case. As a result, the decision may be left unchanged, changed, or overturned.

Appeal period — 14 days

According to Article 369 of the Civil Procedure Code of Georgia (CPC), an appeal must be filed within 14 days from the date of delivery of a copy of the reasoned (motivated) decision. Practically important: the court often announces only the resolution part first, and prepares the reasoned decision later - the 14-day period is calculated from the moment of its delivery. Therefore, if you intend to appeal, you should request a reasoned decision in a timely manner.

Deadline

Missing the deadline usually has serious consequences - the decision becomes effective. If there is a good reason, a petition to restore the deadline is possible, although this is assessed by the court individually and is not guaranteed.

How to make a complaint

The complaint must be made in writing, with the requisites established by law. It must clearly state in which part you disagree with the decision, what legal and factual arguments you have, and what you are requesting (change/cancellation of the appealed decision). The complaint must be accompanied by a document confirming payment of the fee.

Required documents

  • Appeal with a substantiated request;
  • Copy of the appealed decision;
  • State duty payment receipt;
  • Evidence and attachments on which you rely.

State duty

A state fee is payable on an appeal, the amount of which is usually related to the value of the claim. The exact amount and possible benefits (e.g. exemption from the fee due to insolvency) should be checked in advance with the applicable regulations, as they change periodically.

Frequently Asked Questions

Can I present new evidence in the appeal?

The admission of new evidence is limited and is usually only allowed if you can prove that it could not be presented in the first instance for reasons beyond your control.

Is a lawyer necessary?

The law does not require you to hire a lawyer, however, the appeal process imposes formal and legally complex requirements on the complaint, so professional assistance significantly increases the chances of success.

Conclusion

An appeal is a real second chance, but its success depends on timely action. Request a reasoned decision immediately, set a 14-day deadline, and prepare a reasoned appeal. Properly selected factual and legal arguments are crucial.
